Target Test Prep Privacy Policy

99th Score Tutoring, LLC, d/b/a “Target Test Prep” (“Target,” “we,” or “us”) provides, through this web site (the “Site”), the ability to use certain features, services and functions relating to the In-Person Private, Online Private and Classroom test preparation tutoring services offered by Target (the “Services”). The terms and conditions applicable to our Services are set forth in our Target Test Prep User Agreement.

Your privacy is very important to Target. This Privacy Policy sets forth our policies and procedures for collecting, using, and disclosing your information when using this Site and/or our Services.

Persons or users with permission to use the Service are defined as “*Registered Users. *” You may view portions of the Site even if you are not a Registered User of the Services. This Privacy Policy applies to our collection, use and disclosure of personal information from Registered Users of the Site, as well as from persons or users who merely visit the Site.

This Privacy Policy is applicable to your accessing the Services, regardless of how you access them, and by using the Site and/or any of the Services you consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Policy. All of the different forms of data, content, and information described below are collectively referred to as “information.”

1. The Information We Collect and Store

Target may collect and store the following information:

Information You Provide. When you become a Registered User of the Services, we collect some personal and financial information through our registrations forms, such as your name, telephone number, credit card or other billing information, e-mail address and home and business postal addresses. This information allows us to register you as a Registered User of the Services, to bill you for our Services, and to analyze your use of the Services.

Log Data. When you use our Services, we automatically record information from your computer or other device, its software, and your activity using the Services. This may include the device’s Internet Protocol (“IP”) address, browser type, the web page visited before you came to the Site, information you search for on the Site, locale preferences, identification numbers associated with your devices, your mobile carrier, date and time stamps associated with transactions, system configuration information, and other interactions with the Service.

Cookies. We also use “cookies” to collect information and improve our Services. A cookie is a small data file that we transfer to your computer or other device. We may use “persistent cookies” to save your registration ID or account name and login password for future logins to the Services. We may use “session ID cookies” to enable certain features of the Services and to better understand how you interact with the Services. 2. How We Use Personal Information

Personal Information. In the course of using the Services, we may collect personal information that can be used to contact or identify you (“Personal Information”). Personal Information is or may be used: (i) to provide and improve our Services, (ii) to administer your use of the Services, (iii) to better understand your needs and interests, (iv) to personalize and improve your experience, (v) to conduct marketing analysis, (vi) to provide or offer updates of the Services, and (vii) to send promotional and other announcements. If you no longer wish to receive communications from us after you are no longer actively using our Services, please follow the “unsubscribe” instructions provided in any of those communications.

Target uses this information to monitor and analyze use of the Services, for the Service’s technical administration, to increase the Service’s functionality and user-friendliness, and to verify users have the authorizations needed for Target to perform the Services. We also may collect aggregate data. Aggregate data is information collected about a group or category of users from which identities of Registered Users, if applicable, have been removed. In other words, no Personal Information is included in aggregate data. Aggregate data helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor the Services. This Privacy Policy in no way restricts or limits our collection and use of aggregate data, and we may share aggregate data about our users with third parties for various purposes, including to help us better understand our customer needs, to improve our Services, and for advertising and marketing purposes.

3. Information Sharing and Disclosure

Sharing of Person Information. We will not give, sell, rent, share, or trade any of your Personal Information or any other data that you provide when using our Services to any third party, except as outlined in this Privacy Policy or with your consent.

Service Providers, Business Partners and Others. We may use certain third party companies and individuals to help us provide, analyze, and improve the Services (including but not limited to data storage, maintenance services, database management, web analytics, payment processing, and improvement of our Service’s features). These third parties may have access to certain of your information only for purposes of performing these tasks on our behalf and under obligations similar to those in this Privacy Policy.

Compliance with Laws and Law Enforcement Requests; Protection of Target's Rights. We may disclose information to a third party (a) to comply with laws or respond to lawful requests and legal process, (b) to protect Target and its agents, customers, users, and others, including to enforce our agreements, policies, and terms and conditions of use, (c) to prevent fraud or abuse of Target or its users, (d) to protect Target’s property rights, and/or (e) to respond to an emergency, or protect the personal safety of any person, upon the good faith belief that such actions are necessary.

Business Transfers. If we are involved in a merger, acquisition, or sale of all or a portion of our assets, your information may be transferred as part of that transaction, but we will notify you (for example, via e-mail and/or a prominent notice on our website) of any change in control or use of your Personal Information should it become subject to a different Privacy Policy. We will also notify you of choices you may have regarding such information.

Third-Party Applications and Services. We may share your information with third party applications and services, with your consent. For example, certain of our Services involve the use of applications and services offered by Box (http://www.box.com/), Skype (http://www.skype.com/intl/en-us/home), and Cisco WebEx (http://www.webex.com/). We are not responsible for what third parties do with your information, so you should make sure that you trust each third party provider and that each has a privacy policy that is acceptable to you.

Third Party Payment for Services. If your parents, guardian(s) or a third party organization (such as an institution, academic or otherwise) pays for or subsidizes the fees for our Services, we may share your Personal Information with them at their request. This may include information concerning the content of your sessions, our assessment of your progress, specimen test results, and your self assessments and responses to surveys. If you personally pay for your use of the Services, without the involvement of your parents or a third party organization, we will not share your Personal Information.

Non-private or Non-Personal Information. We may disclose your non-private, aggregated, or otherwise non-personal information, such as usage statistics for our Services.

4. Changing or Deleting Your Information; Data Retention

If you are a Registered User, you may review, update, correct or delete the Personal Information provided in your registration or account profile by changing your “account information.” If your personally identifiable information changes, or if you no longer are using our Services, you may update or delete your Personal Information by making the change on your account registration information. We will retain and use your Personal Information and other information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

5. Public Information; Linked Web Sites

Our Services may involve publicly accessible services such as blogs and forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. Your posts may remain even after you stop using our Services. Our Site includes links to other web sites whose privacy practices may differ from those of Target. If you submit personal information to any of those sites, your information is governed by their privacy statements. We encourage you to carefully read the privacy statement of any web site you visit.

6. Security

The security of your information is important to us. When you enter sensitive information (such as a credit card number) on our order forms, we, or trusted third party services acting on our behalf, encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted standards to protect the information submitted to us, both during transmission and once we receive it. No method of electronic transmission or storage is 100% secure, however. Therefore, we cannot guarantee its absolute security.
